Manual in terms of section 51 of the Promotion of Access to Information Act, 2 of 2000 (PAIA)

1. Introduction
This manual is published in terms of section 51 of PAIA for Stelios Group South Africa (“the private body”). PAIA gives effect to the constitutional right of access to information held by public and private bodies where that information is required for the exercise or protection of any right. This manual explains what records we hold and how to request access to them, and provides the information required by PAIA as read with the Protection of Personal Information Act, 4 of 2013 (POPIA).

3. The Regulator’s Guide on how to use PAIA

4. Categories of records we hold
- Company records: founding documents, statutory registers, governance and policy documents, agreements.
- Financial and tax records: accounting records, financial statements, invoices, banking records, tax returns and correspondence with SARS.
- Client records: engagement letters, client accounting, payroll, tax and company secretarial records processed in the course of our services.
- Employee and HR records: employment contracts, payroll records, leave and disciplinary records.
- Website and marketing records: contact-form enquiries and correspondence.
5. Records available in terms of other legislation
Records are kept, and may be available, in accordance with legislation including: the Companies Act 71 of 2008; the Tax Administration Act 28 of 2011; the Income Tax Act 58 of 1962; the Value-Added Tax Act 89 of 1991; the Basic Conditions of Employment Act 75 of 1997; the Labour Relations Act 66 of 1995; the Unemployment Insurance Act 63 of 2001; the Compensation for Occupational Injuries and Diseases Act 130 of 1993; and POPIA.
6. How to request access to records
- Complete the prescribed request form (Form 2, available from the Information Regulator’s website) and send it to our Information Officer at the contact details in section 2.
- Identify the record(s) requested, the right you seek to exercise or protect, and why the record is required for that right.
- Provide proof of identity, and, if you request on someone’s behalf, proof of authority.
- The prescribed request and access fees (published in the PAIA regulations) may apply.
- We will respond within 30 days as required by PAIA. If access is refused, reasons will be provided with reference to the applicable grounds of refusal in the Act.
If a request is refused or not answered, a requester may lodge a complaint with the Information Regulator ([email protected]) or apply to court.
7. Processing of personal information (POPIA)
Purpose of processing: delivering accounting, bookkeeping, VAT, payroll, tax, HR and company secretarial services; administering client relationships; complying with legal obligations; and responding to enquiries.
Categories of data subjects and information: clients and their staff (identity, contact, financial, tax and employment information); our employees (employment and payroll information); website enquirers (contact information); suppliers (business and contact information).
Recipients: service providers under confidentiality obligations; regulators and authorities (such as SARS and CIPC) where required or authorised.
Cross-border flows: limited processing by hosting, email and security providers may occur outside South Africa with safeguards as required by section 72 of POPIA.
Security measures: appropriate, reasonable technical and organisational measures, including encryption in transit, firewalls and access controls.
